TERM

The Contest begins October 2, 2017 and ends December 15, 2017 at 11:59 pm UTC (the Entry Deadline). All entries must be received by the deadline. By submitting an entry, each entrant agrees to the Official Rules and warrants that his or her entry complies with all requirements set out in the Official Rules. This is a skill-based contest and chance plays no part in the determination of winners.

WHO MAY ENTER

The competition is open to any living photographer, 18 years of age or older as of the date of entry, from any country.  

HOW TO ENTER

Purchase is necessary to enter this contest.

THREE EASY STEPS: 1- REGISTER, 2- PAYMENT, 3-UPLOAD IMAGES:

Each Entry consists of an entry form, a single image or series of images, and an entry fee. The “All Entrants” category entry fee is USD $15 per entry for a single image/ $30.00 per entry for a Series (2 to 5 images). To enter, visit www.caribbeanphotocontests.com; complete an entry form with the required information, including your name, address, telephone number, e-mail address, and photo caption; and submit along with your photograph and fee in accordance with the instructions that follow. Each entry must comply with the following requirements (the “Photograph Requirements”):

Photographs must be in digital format. Only online entries will be eligible. No print or film submissions will be accepted for entry into this Contest. The photograph need not be taken with a digital camera; scans of negatives, transparencies or photographic prints are acceptable. Digital photographs should be submitted at the highest resolution possible.

All digital files must not exceed 15MB (megabytes) per file in RGB format, or saved as JPEGs (.jpg) format, and should be at least 150 dpi Photographs must have been taken within two (2) years before the date of entry and may not previously have won an award in the Caribbean Photo Contest.

Only minor burning, dodging and/or color correction is acceptable, as is cropping. High dynamic range images (HDR) and stitched panoramas are NOT acceptable. Any changes to the original Photograph not itemized here are unacceptable and will render the Photograph ineligible for a prize.

Photographs that include sculptures, statues, paintings, and other works of art will be accepted as long as they do not constitute copyright infringement or fraud; provided that entrants must be prepared to provide a release form as described below in “Release”. When photographing the work of others, it must be as an object in its environment and not a full-frame close up of another person’s art.

The photograph, in its entirety, must be a single work of original material taken by the Contest entrant. By entering the Contest, entrant represents, acknowledges and warrants that the submitted photograph is an original work created solely by the entrant, that the photograph does not infringe on the copyrights, trademarks, moral rights, rights of privacy/publicity or intellectual property rights of any person or entity, and that no other party has any right, title, claim or interest in the photograph.

The photograph must not, in the sole and unfettered discretion of the Sponsor, contain obscene, provocative, defamatory, sexually explicit, or otherwise objectionable or inappropriate content.

The entries will be judged in accordance with the Judging Criteria, as defined below. All Entrants must be submitted and received by Dec 15, 2017 at 11:59 pm UTC. Proof of submission is not proof of receipt. Entries must be made by the authorized account holder of the e-mail address submitted at the time of entry. “Authorized account holder” is defined as the natural person who is assigned to an e-mail address by an Internet access provider, online service provider, Internet domain owner, or other person or organization (e.g., business, educational institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. Sponsor reserves the right to examine the original photograph/source material in order to confirm compliance with these rules.

Note: The entry submission page is expected to receive many visitors immediately before the entry deadline. If the website is experiencing a lot of traffic, issues may arise such as slow processing times or the inability to submit entries. To avoid these potential problems, you are encouraged to submit your entries about 14 days before the entry deadlines.

ENTRY FEES

Single Image: $15.00 USD
Series (2 to 5 images)*: $30.00 USD

All Entrants must include the appropriate entry fee payable in U.S. currency.

  1. C) PAYMENT: The entry fee consists of two submission options 1) $15 USD – single image entrance fee or 2) $30.00 USD-Series (2 to 5 images) entrance fee. There is no limit on number of entries.

CATEGORIES

The Fall-2017  & Spring 2018 contest is an “Open Theme”. There is no limit on the number of entries per person. Each entry must comply with the following requirements previously stated above.

IDENTIFYING MARKS & SIGNATURES

No signature, stamp or any other identifying mark is allowed anywhere on the image or digital file. Any submissions that include or contain such marks are automatically disqualified.

CONTEST PRIZES

First Prize: One First Prize will be awarded. The First Prize consists of:

       (1) A Five (5) Day / Four (4) night package for the winner and one (1) guest to Saint Lucia, West Indies;
       (2) The winning image will be featured on the Caribbean Photo Contest website.

One First Prize will be awarded. The First Prize consists of: (1) a 5-day / 4-night stay at Bay Gardens Beach Resort in Rodney Bay, Saint Lucia W.I. for the winner and one (1) guest in 2018; (2) the winning image will be featured on the Caribbean Photo contest website.

The First Prize will include five (5)-day four (4) nights’ accommodations at Bay Gardens Beach Resort (4 Star – award winning resort), ground transportation between the airport and hotel; and meals and other items including trip details are determined by Sponsor in its sole discretion. Travel must be completed by December 31, 2018 or prize trip will be forfeited. Airfare is NOT included. Travel expenses to/from the second prize winner’s home city are not included. Trip dates relate to travel from the United States. Accommodations are subject to availability. Trip specifics are subject to availability. Travelers agree to accept the Caribbean Photo Contest terms and conditions for the trip. All expenses and incidental travel costs not expressly stated in the package description above, including but not limited to, ground transportation; meals; incidentals; gratuities; passenger tariffs or duties; airline fees; surcharges; airport fees; service charges or facility charges; personal charges such as alcoholic beverages, spa services, and Internet usage; security fees; taxes or other expenses are the responsibility solely of winner. The winner and his/her travel companion must execute liability/publicity releases prior to issuance of travel documents. Winner and travel companion are solely responsible for obtaining valid passports and any other documents necessary for international travel. Sponsor reserves the right to substitute the trip for one of equal or greater value if the designated prize should become unavailable for any reason. Approximate Retail Value (“ARV”) of the First Prize is US $5,250. Actual value may vary based on airfare fluctuations and distance between departure and destination. Winner will not receive difference between actual and approximate retail value, if any.

Second Prize: One Second Prize will be awarded. The Second Prize consists of:

       (1) A three (3) day / two (2) night package for the winner and one (1) guest to Saint Lucia, West Indies;
       (2) the winning image will be featured on the Caribbean Photo Contest website.

One Second Prize will be awarded. The second prize consists of: (1) a 3-day / 2-night stay at Bay Gardens Hotel in Rodney Bay, Saint Lucia W.I. for the winner and one (1) guest in 2018; (2) the winning image will be featured on the Caribbean Photo contest website.

The three (3)-day three (2) nights’ accommodations (accommodations are determined by Sponsor in its sole discretion). Travel expenses to/from the second prize winner’s home city are not included. Winner and guest are responsible for getting him/herself to and from Rodney Bay, Saint Lucia. Trip must be completed by December 31, 2018 or prize will be forfeited. Travelers agree to accept the Caribbean Photo Contest terms and conditions for the trip. All expenses and incidental travel costs not expressly stated in the package description above, including but not limited to, ground transportation; meals; incidentals; gratuities; passenger tariffs or duties; airline fees; surcharges; airport fees; service charges or facility charges; personal charges such as alcoholic beverages, spa services, and Internet usage; security fees; taxes or other expenses are the responsibility solely of winner. The winner and his/her travel companion must travel together on the same itinerary. Travel companion must execute liability/publicity releases prior to issuance of travel documents. Winner and travel companion are solely responsible for obtaining valid passports and any other documents necessary for international travel. Sponsor reserves the right to substitute the trip for one of equal or greater value if the designated prize should become unavailable for any reason. If Second Prize winner is unavailable to travel during the calendar year of 2015 then the prize will be forfeited. Approximate Retail Value (“ARV”) of the First Prize is US $3,850. Actual value may vary based on time of prize redemption. Winner will not receive difference between actual and approximate retail value, if any.

Participants Award for Most Popular Entry

Third Prize: One Third Prize will be awarded. The Third Prize consists of:

  1. A $500 prepaid Amazon gift-card
  2. The winning image will be featured on the Caribbean Photo Contest website.

Actual value is $500 USD. Winner will not receive difference between actual and approximate retail value, if any.

Potential winners shall be required to sign and return within ten (10) days following an attempted notification, an Affidavit, Declaration or Certificate of Eligibility, Liability Release, and where legally permissible, a Publicity Release and Warranty of Ownership and License in which the entrant warrants that he/she is the owner of the photograph (and all the intellectual property rights in the photograph submitted) and grants to Sponsor and its licensees the irrevocable, perpetual, worldwide non-exclusive license to reproduce, distribute, display, and create derivative works of the entry (along with a name credit) in connection with the Contest and promotion of the Contest without additional compensation. Failure to execute and deliver any required documents to Sponsor by the specified deadline may result in disqualification from the Contest, and selection of an alternate potential winner. No prize transfer, assignment, or substitution by winners permitted. If a prize (or part of a prize) is unavailable, the Sponsor, in its discretion, reserves the right to substitute the original prize (or that part of the prize) with an alternative prize to the equal monetary value and/or specification, unless to do so would be prohibited by law.

NONCOMPLIANCE OR RETURN OF PRIZE NOTIFICATION AS UNDELIVERABLE, WHETHER BY REGULAR MAIL OR BY E-MAIL, MAY RESULT IN DISQUALIFICATION AND SELECTION OF AN ALTERNATIVE POTENTIAL WINNER.

JUDGING

Contest consists of two (2) rounds of evaluation:  In Round One, the best image selected by each candidate will be posted where the general public can cast their vote for the best images.

In the 2nd round, a panel of Caribbean Photo Contest experts in photography (the “Judges”) will each review all eligible entries based on the following criteria (“Judging Criteria”): (1) Creativity 50%; (2) Photographic quality 50% and select a group of entries from contestants that proceed to the next round/s.  Entries will be judged on the basis of creativity, photographic quality and effectiveness in expressing the contest theme. Winners will be published on the “Caribbean Photo Contest” Web site. Limit one prize per winner. The results will render the three (3) finalist/s (i.e. Prize Winners).

*Prize winners will be notified by email and announced in our e-newsletter no later than 8 weeks after the end date of the contest.

Decisions of the Sponsors and Judges are final and binding. Sponsors reserve the right not to award all prizes in the event an insufficient number of eligible entries meeting the minimum judging criteria are received, as determined by Sponsors and Judges in their sole discretion.

WINNERS

Entrants are responsible for complying with these Official Rules. Prize winners’ names will be available online June 19, 2018 at www.caribbeanphotocontest.com.

ENTRANT LICENSES/RELEASES

If the photograph contains any material or elements that are not owned by the entrant and/or which are subject to the rights of third parties, and/or if any persons appear in the photograph, the entrant is responsible for obtaining, prior to submission of the photograph, any and all releases and consents necessary to permit the exhibition and use of the photograph in the manner set forth in these Official Rules without additional compensation. If any person appearing in any photograph is under the age of majority in their state/province/territory of residence the signature of a parent or legal guardian is required on each release.

Upon Sponsor’s request, each entrant must be prepared to provide (within 7 calendar days of receipt of Sponsor’s request) a signed release from all persons who appear in the photograph submitted, and/or from the owner of any material that appears in the photograph entry, authorizing Sponsor and its licensees (“Authorized Parties”) to reproduce, distribute, display and create derivative works of the entry in connection with the Contest and promotion of the Contest, in any media now or hereafter known. All releases must be in the form provided by Sponsor. Failure to provide such releases upon request may result in disqualification at any time during the Contest and selection of an alternate winner.

Similarly, upon Sponsor’s request, each entrant must be prepared to provide (within 7 calendar days of receipt of Sponsor’s request) a signed written license from the copyright owner of any sculpture, artwork or other copyrighted material that appears in the photograph entry, authorizing any Authorized Party to reproduce, distribute, display and create derivative works of the entry in connection with the Contest and promotion of the Contest, in any media now or hereafter known. All releases must be in the form provided by Sponsor. Failure to provide such releases upon request may result in disqualification and selection of an alternate winner.

Finally, upon Sponsor’s request, each entrant must be prepared to provide (within 7 calendar days of receipt of Sponsor’s request) a signed written license from the owner of any private property included in the photograph entry, authorizing any Authorized Party to reproduce, distribute, display and create derivative works of the entry in connection with the Contest and promotion of the Contest, in any media now or hereafter known. All releases must be in the form provided by Sponsor. Failure to provide such releases upon request may result in disqualification and selection of an alternate winner                      

For the purposes of these Official Rules, the entrant will be deemed to be in receipt of Sponsor’s request or notification, (a) in the event that Sponsor sends the request by postal mail, five business days after the request was sent by Sponsor, or (b) in the event that Sponsor sends the request by e-mail, on the day that the e-mail was sent by Sponsor.

By participating, ALL ENTRANTS grant the Sponsors and their designees, licensees or affiliates (the “Authorized Parties”) a non-exclusive, worldwide license, through December 24, 2021, to reproduce, distribute, display and post the entries online so that viewers may view all competing entries. In addition, each WINNER grants to the Authorized Parties a license for use of his/her winning entry in connection with the Contest and promotion of the Contest, in any media now or hereafter known, including but not limited to, print or digital publication on the CPC Website showcasing the winners; and promotions related to the contest. Authorized Parties will not be required to pay any additional consideration or seek any additional approval in connection with such use.

THIRD PARTY RELEASES/LICENSES

Winners authorize The Caribbean Photo Contest to reproduce, distribute, display and create derivative works of the photograph entry in connection with 2017/2018 Photo Contest and promotion of 2017/2018 Photo Contest, in any media now or hereafter known, including but not limited to: publication on The CPC website showcasing the winners; The 2017/2018 Photo Contest live gallery; the 2017/2018 Photo Contest Web site and in exhibits and promotions related to the 2017/2018 photo contest.

LIMITATION OF LIABILITY

By participating, entrants agree to release, discharge and hold harmless Caribbean Photo Contest, and each of their respective partners, affiliates, subsidiaries, advertising agencies, agents and their employees, officers, directors, and representatives from any claims, losses, and damages arising out of their participation in this Contest or any Contest-related activities and the acceptance and use, misuse, or possession of any prize awarded hereunder.  

Sponsors assume no responsibility for any error, omission, interruption, deletion, defect, or delay in operation or transmission; communications line failure; theft or destruction of or unauthorized access to Contest entries or entry forms; or alteration of entries or entry forms. Sponsors are not responsible for any problems with or technical malfunction of any telephone network or lines, computer online systems, servers or providers, computer equipment, software, failure of any email entry to be received on account of technical problems or traffic congestion on the Internet or at any Web site, human errors of any kind, or any combination thereof, including any injury or damage to entrants’ or any other persons’ computers related to or resulting from participation, uploading or downloading of any materials related to this Contest.

CONDITIONS

THIS CONTEST IS VOID WHERE PROHIBITED. Entrants agree that this Contest shall be subject to and governed by the laws of the State of New Jersey and the forum for any dispute shall be in the State of New Jersey, United States of America. To the extent permitted by law, the right to litigate, to seek injunctive relief or to make any other recourse to judicial or any other procedure in case of disputes or claims resulting from or in connection with this Contest are hereby excluded and any entrant expressly waives any and all such rights. Certain restrictions may apply. Entries void if the Sponsor determines the photograph to not be an original, or if the entries are illegible, incomplete, damaged, irregular, altered, counterfeit, produced in error or obtained through fraud or theft.

By entering, entrants also agree (a) to be bound by these Official Rules; (b) that the decisions of the Judges are final and binding with respect to all matters relating to the Contest; and (c) if the entrant wins, that Sponsor may use the winning photographs and each winner’s name, photograph, likeness, and/or voice in any publicity or advertising relating to the Contest or future promotions without compensation or approval (except where prohibited by law). All federal, state/provincial/territorial and local taxes, fees and surcharges and taxes (whether foreign or domestic, and including income, sales, and import taxes) on prizes are the sole responsibility of the prize winners. In the event that the selected winner(s) of any prize is/are ineligible, cannot be traced or do not respond within 10 days to a winner notification as required by the “Contest Prizes” Rules above, or refuses the prize, the prize will be forfeited and Sponsor, in its sole discretion, may choose whether to award the prize to another entrant.

The Sponsor reserves the right to verify the validity and originality of any entry and/or entrant (including an entrant’s identity and address) and to disqualify any entrant who submits an entry that is not in accordance with these Official Rules or who tampers with the entry process. Failure by the Sponsor to enforce any of its rights at any stage does not constitute a waiver of those rights 

RIGHT TO CANCEL OR SUSPEND CONTEST

If for any reason the Contest is not capable of running as planned, due to infection by computer virus, bugs, worms, trojan horses, denial of service attacks, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of Sponsors that corrupt or affect the administration, security, fairness, integrity, or proper conduct of this Contest, Sponsors reserve the right, at their sole discretion, to disqualify any individual(s) who tamper with the entry process, and/or to cancel, terminate, modify, or suspend the Contest. If Sponsors elect to cancel or terminate the Contest, Sponsors will not retain any rights in the submitted photographs and will return the entry fees.

DATA PRIVACY

Entrants agree that personal data, especially name and address, may be processed, shared and otherwise used for the purposes and within the context of the Contest and any other purposes outlined in these Official Rules. The data may also be used by the Sponsor in order to verify the participant’s identity, postal address and telephone number or to otherwise verify the participant’s eligibility to participate in the Contest. Participants have the right to access, review, rectify or cancel any personal data held by Sponsor by writing to Sponsor at Caribbean Photo Contest, P.O. Box 355 Perinneville, NJ 08535.  Personal data will be used by Sponsor and its affiliates exclusively for the purposes stated herein.

NOTICE TO INDIVIDUALS: REMOVAL FROM MAILING LIST: Any individual (or other duly authorized person) may elect to exclude the name and address of that individual from all lists used by Caribbean Photo Contest to mail skill contests or sweepstakes. To elect to have an individual’s name excluded from all such lists, submit a removal request in writing to: Caribbean Photo Contest, P.O. Box 355, Perinneville, NJ 08535.  This notification system may be used to prohibit mailing of all skill contests or sweepstakes by the Caribbean Photo Contest to such individual.

WHO MAY ENTER

The “College Students” category is only for students currently enrolled at a college or university over 18 years of age at the time of entry.

CONTEST TERM

Contest begins September 18, 2017 at (12:01:00 AM) US Eastern Standard Time (EST) and ends December 8, 2017 at (11:59:00 pm) US Eastern Daylight Time (EDT) (the “contest”). Submission entries must be received before the entry period ends in order to participate in contest. Information on how to enter and prizes form part of these official rules (“Official Rules”). By entering contest, each entrant agrees to the Official Rules and warrants that his or her entry complies with all requirements set out in the Official Rules. There are three rounds to this contest. In Rounds 1 & 3 contestants images are judged by selected judges determined by the CPC on their skill, creativity, and artistic ability. Round 2 is determined solely by the public through Internet voting.

Payments can be made by Credit Card, Money Order, or Check. Once entry fee is received entrants will receive permission to submit/upload images. Only images submitted/uploaded online will be accepted. No responsibility is assumed for lost, late or misdirected submission entries.

Each entry must comply with the requirements stated below:

A) Submissions must be entered online at caribbeanphotocontests.com in accordance to the instructions specified in the general contest rules. Digital Files are the only acceptable format for submission. Only online entries will be eligible. No print or film submissions will be accepted for entry into this Contest. The photograph need not be taken with a digital camera; scans of negatives, transparencies or photographic prints are acceptable.

  • All digital submissions must be no larger than 1600 Pixels in either height or width and saved as Jpegs (.jpg), in RGB format and not exceed 15 MB per file, at 150dpi. Images will be viewed on a large monitor and should be in the Adobe RGB or sRGB color space. Filenames should contain contestants name and ranking number for the respective number of images entered. (Ex. File 001 – John Doe #1, File 002 – John Doe #2)
  • MANIPULATIONS/ MODIFICATIONS: Images that are modified are not allowed!! Minor burning, dodging and color correction is acceptable. (The original Raw or Tiff file of an image and/or negative should be saved for review in the event concerns arise regarding the authenticity of an image/s or unauthorized image modifications or manipulations.) 
  • B) AUTHENTICITY & COMPLIANCE: Images should be presented as taken, with as little alteration as possible. Please note: “No visible time or date stamps are allowed on entries”. Photographs must have been taken within (2) years before the date of entry and must not have been previously published.

The Caribbean Photo Contest LLC assumes no responsibility for images submitted to the contest by entrants that have been previously published. Winning images selected for final round are not allowed in future contests. Any winning image/photograph found to be altered will be disqualified from winning. Entrant must be the owner of the photograph, or otherwise have the right to submit the photograph for consideration in the Contest.

By entering the Contest, the entrant declares and assumes full responsibility for images and for ensuring that images are copyright protected. Entrant also acknowledges and warrants that the submitted image or photograph is the original work created solely by the entrant, that the photograph does not infringe upon any copyrights, trademarks, rights of privacy, publicity, or intellectual property of any person or entity and that no other party has any right, title, claim or interest in the photograph.

Any entrant whose photographic submission fails to comply with their requirements set forth may be disqualified. All submission entries that are not owned by the entrant and/or which are subject to the rights of third parties and/or if any persons appear in the photograph, the entrant’s responsible for obtaining any and all releases and consents necessary to permit and authorize the publication and use of the photograph in a manner set forth in the Official Rules without any additional compensation. If person appearing in any photograph is under the age of majority, the signature of a parent or legal guardian is required on release. If feasible, each entrant should be prepared to provide a signed written personal release from all persons who appear in the image/photograph submitted, and/or from the copyright owner of any sculpture, artwork or copyrighted material that appears in the photograph entry, authorizing use of the photograph entry, authorizing use of the photograph in editorial publications, marketing and promotions in any and all media.

C) PAYMENT: The entry fee consists of two submission options 1) $15 USD – single image entrance fee or 2) $30.00 USD-Series (2 to 5 images) entrance fee. There is no limit on number of entries.

Submission entries must be images created by the contestant/photographer. Any entries submitted that prove to be created by anyone other than the contestant will automatically be disqualified from the competition and will also be banned from participating in any other contest promoted by the Caribbean Photo Contest LLC – CONTEST IS VOID WHERE PROHIBITED.

Contest consists of three (3) rounds of evaluation:

In the 1st round, the best image selected by each candidate will be posted where the general public can cast their vote online for the best images. Online voting is open to the public which occurs throughout the duration of the contest (Beginning September 10, 2017 – ending December 9, 2017).  Online voting criteria are based solely on two criteria: 1) the contestant’s ability to garner votes from the general public. 2) The quality of images submitted.  The results will render the top one hundred (100) finalist/s who qualify to advance to the 2nd round.

In the 2nd round, a panel of Caribbean Photo Contest experts in photography (the “Judges”) will each review all eligible entries based on the following criteria (“Judging Criteria”): (1) Creativity 50%; (2) Photographic quality 50% and select a group of entries from contestants that proceed to the 3rd and final round.  Entries will be judged on the basis of creativity, photographic quality and effectiveness in expressing the contest theme. Winners will be published on the “Caribbean Photo Contest” Web site. Limit one prize per winner. The results will render the fifty (50) finalist/s who qualify to advance to the 3rd and final round.

All the judging is based on technical quality, artistic expression, creativity and difficulty. In the event of a tie, those entries will be re-submitted to the Judges for re-judging between the tied entries alone. The CPC reserves the exclusive right regarding judging to determine winners. Decisions of the Judges are final and binding. 

    • Round 1 Online Voting occurs throughout the duration of the contest (Beginning September 10, 2017 – ending on December 9, 2017).  The top 100 contestants selected to advance to the second round will be posted online at www.caribbeanphotocontests.com.
    • Round 2 Judging occurs from (January 8, 2018 to January 26, 2018).  Fifty (50) finalists will be chosen from the top one hundred (100) contestants to advance into the 3rd and final round of the competition and qualify to compete for the grand prize in the Caribbean on the island of Saint Lucia (Additional prizes awarded are listed below). Finalists chosen to compete in the third and final round will be divided into five (5) groups (Groups A-E) who will to travel to designated host country during specified dates listed below.
    • Announcement Period (Feb 12, 2018 to Feb 24, 2018)
    • Round 3 of the competition occurs from June 8, 2018 – August 7, 2018 in the host country and is applicable only to contestants designated as finalists.

Note: Contestants designated as “Finalists” will be divided into five groups with corresponding 3rd round competition dates.

 Finalists who are unable to travel to host country will automatically be disqualified. Finalists who win the opportunity to travel and participate in third round of competition in designated host country 1) must pass and submit medical physical including immunizations from a licensed Physician. 2) Must possess a valid passport or legal documents to be allowed entry into host country. 3) Must provide a picture ID with proof of age for verification. 4) Must provide an official transcript verifying current registration from the respective educational institutions.

TAX CONSQUENCES: Federal, state and/or local taxes are the responsibility of the Winner. The determination of liability for any federal, state and/or local taxes that may arise out of the entrant’s participation in the Contest (including the entrant’s receipt of any prizes), and the payment of any such tax liability, shall be the sole responsibility of the entrant. However, should federal, state and/or local law impose any tax reporting or filing obligations on Caribbean Photo Contest LLC and arising out of the entrant’s participation in the Contest (including the entrant’s receipt of any prizes), the entrant agrees to timely provide with any information that is reasonably necessary for Caribbean Photo Contest LLC to comply with any such reporting or filing obligations. In addition, should federal, state or local law impose any tax withholding obligation on with respect to Caribbean Photo Contest LLC entrant’s receipt of any prizes, the entrant agrees to such withholding and shall timely provide any information to Caribbean Photo Contest LLC as may be required for Caribbean Photo Contest LLC to accomplish such withholding.

PRIZES: A total of (50) fifty prizes, with a total approximate retail value of $275,000. Approximate retail value of prizes received by each winner is $5,500. Prizes awarded are applicable and awarded only to Finalists who are approved by the Caribbean Photo Contest LLC after eligibility verification. Fifty (50) finalists become eligible to receive a new Digital SLR Camera package, win a 6 day/ 5 night photo expedition and workshop in the Caribbean on the Island of Saint Lucia, that includes lodging accommodations and 3 meals daily for 5 nights, including an awards ceremony and luncheon. After two (2) competition rounds and successful eligibility verification, the Fifty (50) finalists are invited to compete in the third and final round of the contest for a total of $10,200 in scholarship & award prizes. In the third round of the contest, the ten (50) finalists will travel, participate in a photo expedition and workshop that includes competing in a photographic and essay contest on-location in the island of Saint Lucia. While in Saint Lucia, finalists compete for the Grand Prize, a $5,000 scholarship award. The third and final round of the competition will be in conjunction with the photo expedition and workshops. The theme in the third and final round will be announced only to the finalists. During the third round finalists will be required to submit a one thousand-word essay along with the digital images captured in Saint Lucia for the Grand Prize judging.

Each winner will receive prizes that consist of only those items specifically listed as part of the prize. No substitution or duplicate prizes will be awarded. Prizes are not transferable, redeemable for cash or exchangeable for any other prize. Spending money, transfers, meals (other than specified), transport to and from departure point, travel documentation (such as passports and visas), insurance, items of personal nature and all other expenses are not included and are the responsibility of each winner. Frequent flyer points may not form part of the prize. Finalists may be required to present a valid credit card at the time of check in at hotel accommodation. Approximate retail value (ARV) of each prize is $5,500. Finalists competing in 3rd and final round must compete on dates specified by the Caribbean Photo Contest LLC. The prize may not be combined with any other offer and is subject to booking and flight availability. Regulations and conditions may apply. By accepting the prize, winners understand that they will be competing in a photo-essay competition for the Grand Prize while the Expedition/Workshop is conducted. Winners also agree that they understand that all travel, both in route to and from host country and travel within host country whether in developed or remote areas and whether by plane, automobile, boat, raft, or other conveyance, or by foot, on land or water, and in the air, contains inherent risks like accident, illness, injury, loss or death, which may be caused by negligence, forces of nature, wild animals other agencies, known or unknown. Contestants who become finalists represent that they recognize that such risks may be present at any time before, during and after the trip. Contestants also recognize that in order to be considered a finalist and participate in the expedition/workshop & photographic essay contest in host country potential winners acknowledge that they accept the risk and must confirm acceptance of such risk if declared a finalist.

Contestants selected as finalists will be required to sign and return within (7) days following an attempted notification, an Affidavit, Declaration or Certificate of Eligibility, Liability Release, and where legally permissible a Publicity Release and Warranty of Ownership and License in which contestant warrants the he/she is the owner of the Photograph/Image and grants the CPC, the Host Country and Host Hotel the right to utilize the photograph/image in any and all media without any additional compensation. If contests are selected as winner/s and cannot be contacted those contestants will automatically be disqualified. The Caribbean Photo Contest LLC reserves the right to determine an alternate winner or not to award that winner’s prize.

Any decisions regarding prizes awarded are the sole discretion of Caribbean Photo Contest LLC.

A) RESTRICTIONS: Employees of Caribbean Photo Contest LLC., its affiliates, and subsidiaries are not eligible. All federal, state and local laws and regulations apply. Void where prohibited by Law. Contestants selected as finalists will not be allowed to participate in future contests for a period of 24 months.

B) THEMES: Open Theme, is designated only to the First Round of competition and is defined as conveyed with the following restrictions. (“Restrictions”, nudity, pornography, vulgarity, clichés, etc. are not permitted.)

Important** Finalists: The contestants that qualify to advance to the 3rd and final round in Saint Lucia will be announced during the announcement period from Feb 12, 2018 to Feb 24, 2018. 3rd Round Theme: The designated theme will be announced at a later date and pertains only to contestants that advance into the final round of competition. 

C) ONLINE VOTING CRITERIA: Online voting is open to the public and is based solely on two criteria: 1) The contestant’s ability to garner votes from the general public. 2) The quality of images submitted.

D) JUDGING CRITERIA: All the judging is based on technical quality, artistic expression, creativity and difficulty. In the event of a tie, those entries will be re-submitted to the Judges for re-judging between the tied entries alone. The CPC reserves the exclusive right regarding judging and re-judging to determine winners. Decisions of the Judges are final and binding.

E) USAGE RIGHTS/LICENSE: By submitting images, you understand and agree that selected entries and the entrants names can and may be used and published by Caribbean Photo Contest LLC and/or the Host Country and Host Hotel or any other Authorized Party in any and all CPC promotional or advertising material, publications, or its own website, or any other media at the discretion of the CPC. All copyrights are retained by the photographer. Recognition will be given to the photographer whenever possible. By entering the Contest, all entrants grant a royalty free irrevocable perpetual non-exclusive license in the entries to Authorized parties, and Acknowledge that Authorized Parties may use the entries and a name credit in any media now or hereafter known, without the restriction, including commercially using and exploiting the entries to the fullest extent possible. Display or publication of any entry on an Authorized Party’s website does not indicate the entrant will be selected as a winner. Authorized parties will not be required to pay any additional consideration or seek any additional approval in connection with such use or exploitation. Consequently, by entering, each entrant grants to Authorized Parties the unrestricted right to use all statements made in connection with the Contest, and pictures or likeness of Contest entrants, or choose not to do so, at their sole discretion. Authorize Parties will not be required to pay any additional consideration or seek any additional approval in connection with such use or exploitation.

F) RIGHT TO CANCEL OR SUSPEND CONTEST: In the event the Caribbean Photo Contest LLC is not capable of running the Contest as planned due to infection by computer virus, bugs, glitches, worms, Trojan horses, denial of service attacks, tampering, unauthorized intervention, Fraud, technical failures, or any other causes beyond the control of the CPC LLC that corrupt or affect administration, security, fairness, integrity, or proper conduct of this Contest, the CPC LLC reserves the right, at its sole discretion, to disqualify any individual(s) who tamper with the entry process, and/or terminate, modify, or suspend the Contest. If the CPC LLC elects to cancel or terminate the Contest, the CPC LLC will not retain any rights in the submitted photographs.

Caribbean Photo Contest LLC reserves the right, in its sole discretion, to reject any photographs. No inappropriate, indecent or obscene photographs may be submitted to Caribbean Photo Contest LLC for entry into the Contest or submitted for display on the Caribbean Photo Contest LLC Website. Visitors to the Caribbean Photo Contest LLC Website may notify Caribbean Photo Contest LLC through the “Contact Us” button of any photographs or captions that appear to violate these Official Rules. Caribbean Photo Contest LLC will use its best efforts to exclude any such photographs or captions; however, Caribbean Photo Contest LLC is not a publisher of the images; it is merely providing a forum for the display of these photographs for judging and voting purposes and, therefore, Caribbean Photo Contest LLC expressly disclaims any and all liability associated with the display of any of the photographs on the Caribbean Photo Contest LLC Website.

General Rules:

General photo contest rules apply to entry rules and requirements. The contest runs annually. Winners will be notified by e-mail and announced in our e-newsletter. The grand prize and approximate total retail values of prizes offered vary from year to year. Finalists must be able physically able to travel to an island in the Caribbean region during the designated dates set forth in contest entry rules. Entrants are responsible for complying with Contest rules.

Odds of winning are based on three factors 1) Entrants -The number of entries received. 2) Judging – The quality of the images submitted by each contestant. 3) Voting- the amount of votes cast for each contestant.

The Caribbean Photo Contest judges select the top photographers and their favorite images among all submission entries upon completion of the contest. Finalists are sent an email notification; the finalists are posted online at www.caribbeanphotocontests.com and in the e-newsletter.

Finalists are chosen by Judges selected by the Caribbean Photo Contest and through public internet voting. All prizes are non-transferable. Finalists will be notified by email and announced in our e-newsletter no later than 10 weeks after the end date of the contest. The College Students Contest ends December 9, 2017. Finalist announcements will be made Feb 12, 2018 to Feb 24, 2018.  

By submitting images in our photo contest you give Caribbean Photo Contest, LLC the legal right to use and publish your submitted materials once chosen to be among the finalists for future brochures, newsletters and other campaigns without monetary compensation. Some photos will be selected and acknowledged in the Caribbean Photo Contest e-newsletter “Off the Beaten Path”. You also acknowledge that the image was taken by you, and that any identifiable persons in your images have approved your submission to this contest. Participants must be students enrolled in an accredited educational institution 18 years old and above.

THIS CONTEST IS VOID WHERE PROHIBITED. Despite an entrants’ locale, entrants agree that this Contest shall be subject to and governed by and subject to the laws of the State of Delaware, United State of America, hence, entrants agree that they must interpret these Contest rules in accordance with the State of Delaware. By entering the contest and agreeing to our terms and conditions, the entrants, finalists and winners confirm their eligibility and compliance with the contest rules and release Caribbean Photo Contest, its partners and affiliates and their respective advertising and promotional agencies from all liability caused by, or resulting from, the acceptance or use of the contest prizes.

This contest is open to all participants who meet the guidelines, except employees of the Caribbean Photo Contest, its partners and affiliates and their respective advertising and promotional agencies. Students in countries or provinces where they are prohibited or restricted from entering online contests are also prohibited from entering.

Entries void if the Caribbean Photo Contest determines the photograph to not be an original, or if entries are illegible, incomplete, damaged, irregular, altered, counterfeit, produced in error or obtained through fraud or theft.

Entrants also agree: 1) to be bound by these Official Rules; 2) that the decisions of the Judges are final and binding with respect to all matters relating to the contest; and 3) if the entrant becomes a Finalist, Grand prize winner, second place, or third place, or designated as Honorable mentioned that the Caribbean Photo Contest LLC supersedes and maintains ultimate authority and reserves the right over its partners, authorized parties, affiliates, subsidiaries, advertising agencies, and agents to use the winning photographs/images and each winners name, photograph, likeness, and/or voice in any publicity or advertising relating to the Contest or future promotions without compensation or approval. All federal, state/provincial/territorial and local taxes (whether foreign or domestic, and including income, sales, and import taxes), fees and surcharges on prizes are the sole responsibility of the prize winners. In the event that the selected winner(s) of any prize are/is ineligible or refuses the prize, the prize will be forfeited and the Caribbean Photo Contest LLC, in its sole discretion, may choose whether to award the prize/s to another entrant.

The Caribbean Photo Contest LLC reserves the right to verify the validity and originality of any entry and/or entrant (including an entrant’s identity and address) and to disqualify any entry that is not in accordance with these Official Rules. Failure by the CPC to enforce any of its rights at any stage does not constitute a waiver of those rights.

By entering this Contest, entrants agree to release, discharge and hold harmless Caribbean Photo Contest LLC and its partners, Authorized Parties, affiliates, subsidiaries, advertising agencies, agents, and their employees, officers, directors, and representatives from any claims, losses, and damages, arising out of their participation in this contest or any contest-related activities, including travel, and the acceptance and use, misuse, or possession of any prize awarded hereunder. To the extent permitted by law, the right to litigate, to seek injunctive relief or to make any other recourse to judicial or any other procedure in case of disputes or claims resulting from or on connection with this Contest are hereby excluded and any entrant expressly waives any and all such rights. Certain restrictions may apply.

Caribbean Photo Contest LLC, Capture Tours (www.capturetours.com), its partners, affiliates and their respective advertising and promotional agencies each assume no responsibility for lost, stolen, delayed, damaged, or misdirected entries, or for any failure of the website during this contest, for any problems or technical malfunction of any telephone network or lines, computer online systems, services, access providers, computer equipment, software, failure of any e-mail or entry to be received by Caribbean Photo Contest on account of technical problems or traffic congestion on the internet or the website or any combination thereof including any injury or damage to an entrants, or any other persons computer, related to or resulting from playing or downloading any material in the promotion. Any attempt to deliberately damage the website or to undermine the legitimate operation of this promotion is a violation of Criminal and Civil laws, and should such an attempt be made Caribbean Photo Contest reserves the right to seek remedies and damages to the fullest extent permitted by law, including criminal prosecution. The entrants maintain copyright of all images submitted and allow Caribbean Photo Contest unlimited use for acknowledgement, promotional and publicity purposes. No correspondence will be entered into except with the selected finalists who will be notified by email and announced in our e-newsletter. Entrants, by entering this contest, agree to abide by these contest rules. Contest winners must consent to the use of their name or photograph/image without compensation, in any publicity carried out by Caribbean Photo Contest or Host Country.

Entrants agree that the personal information, especially name and address collected for purposes of this contest can be collected, used and disclosed by Caribbean Photo Contest in accordance with its privacy policy which is available on its web site. The information may also be used by the CPC LLC in order to verify the participant’s identity, postal address and telephone number or to otherwise verify the participant’s eligibility to participate in the Contest. The Contest begins May 21, 2017 at 12:01 UTC and ends August 5, 2017 at 11:59 pm UTC (the Entry Deadline). All entries must be received by August 5, 2017 at 11:59pm EST. Information on how to enter and prizes form part of these official rules (“Official Rules”). By submitting an entry, each entrant agrees to the Official Rules and warrants that his or her entry complies with all requirements set out in the Official Rules. This is a skill-based contest and chance plays no part in the determination of winners.

WHO MAY ENTER
Eligibility: Contest is open only to legal residents of the continental United States (Only) who are in 9th through 12th grades at the time of entry, and who meet the Admissions Criteria as described below in “Judging Criteria and Conditions.” You must have permission from a parent or legal guardian to enter the Contest. If selected as a Finalist, you will be required to provide your parent or legal guardian’s written consent to your participation, and if you fail to provide such written consent within three business days of the request then you may be disqualified. Officers, directors and employees of Sponsor, Caribbean Photo Contest, subsidiaries, affiliates, members, distributors, retailers, sales representatives, advertising and promotion agencies, and each of their immediate family members and/or people living in the same household are NOT eligible to enter the Contest or win a prize. This Contest is void where prohibited.

HOW TO ENTER
All entries must be submitted in digital format through our online entry form. To enter, visit https://caribbeanphotocontests.com// (“Website”) register and complete the entry form by following the step-by-step directions on that page. Submit an original photograph, taken by you, that conveys what intrigues you or that your very passionate about (“Photograph”). Include a title for the Photograph, a written description (100 words or less) of the “moment” captured and how it reflects a sense of Intrigue and/or Passion (“Description”), the location where you took the Photograph, and the names of any persons in the Photograph (if known). Your entry must also comply with the following requirements (the “Entry Requirements”):

  • All photograph submissions must be 20 megabytes or smaller, must be in
  • JPEG or JPG format, and must be at least 1,600 pixels wide (if a horizontal image) or 1,600 pixels tall (if a vertical image).
  • Minor burning, dodging and/or color correction is acceptable. Hand tinting is acceptable, as is cropping. Fish-eye lenses are acceptable. High dynamic range images (HDR) and stitched panoramas are acceptable only if the combined parts are all made around the same time. Any changes to the original Photograph not itemized here are unacceptable and will render the Photograph ineligible for a prize.
  • Photographs that include sculptures, statues, paintings, and other works of art will be accepted as long as they do not constitute copyright infringement or fraud. When photographing the work of others, it must be as an object in its environment and not a full-frame close up of another person’s art.
  • The Photograph and the Description, each in its entirety, must be a single work of original material taken and written (respectively) by the contest entrant. By entering the Contest, entrant represents, acknowledges and warrants that the submitted Photograph and Description are original works created solely by the entrant and that no other party has any right, title, claim or interest in the Photograph or the Description.
  • Though entrants retain copyright in each image submitted, the digital image file(s) submitted will not be returned or acknowledged.
  • Obscene, provocative, or otherwise objectionable content will not be considered, and such determination is solely at the discretion of Sponsor.
  • Each entrant may submit up to five Photographs and accompanying Descriptions.

The entries will be judged in accordance with the Judging Criteria, as defined below. All entries must be submitted and received by August 5, 2017 at 11:59 pm EST. Proof of submission is not proof of receipt.

RELEASE
If the Photograph contains any material or elements that are not owned by the entrant and/or which are subject to the rights of third parties, the entrant is responsible for obtaining all releases and consents necessary to permit the exhibition and use of the Photograph in the manner set forth in these Official Rules without additional compensation. Where feasible, entrants should obtain a personal release from all persons who appear in the Photograph submitted, authorizing use of the Photograph in Sponsor’s promotional materials to feature the winning entry, without compensation, permission or notification, unless prohibited by law. Failure to provide such releases upon request may result in disqualification and selection of an alternate winner.

LICENSE
Each entrant retains the copyright to his/her Photograph(s) and Description(s), but explicitly grants Sponsor, their licensees, affiliates and their designees (collectively, the “Authorized Parties”) an irrevocable, nonexclusive, worldwide license for the duration of copyright to use each Photograph and Description for advertising, marketing, and promotional purposes, in any and all media now known or hereafter created, including but not limited to publication in catalogs, brochures, blogs, and websites, at Authorized Parties’ discretion, without additional consideration, notification, permission to entrant or any third party.

CONTEST PRIZE
THE WINNER IS REQUIRED TO SIGN AN AFFIDAVIT OF ELIGIBILITY AND LIABILITY RELEASE; WARRANTY OF OWNERSHIP AND LICENSE; AND PUBLICITY RELEASE (COLLECTIVELY, THE “AFFIDAVIT”), UNLESS PROHIBITED BY LAW, WITHIN 15 DAYS FROM THE DATE OF NOTICE FOR SPONSOR TO AWARD THE PRIZE. NONCOMPLIANCE OR RETURN OF PRIZE NOTIFICATION AS UNDELIVERABLE MAY RESULT IN DISQUALIFICATION AND SELECTION OF AN ALTERNATE WINNER.

One (1) Grand Prize Winner, one (1) Second Place Winner, and one (1) Third Place Winner will be selected. All “Finalists” (Prize Winners) winning images will be featured on the Caribbean Photo contest website. Retail values of Prizes may vary depending on cost fluctuations and other variables. JUDGING CRITERIA AND CONDITIONS
Contest consists of two (2) rounds of evaluation:  In Round One, the best image selected by each candidate will be posted where the general public can cast their vote for the best images.  In the 2nd round, a panel of Caribbean Photo Contest experts in photography (the “Judges”) will each review all eligible entries based on the following criteria (“Judging Criteria”): (1) Creativity 50%; (2) Photographic quality 50% and select a group of entries from contestants that proceed to the next round/s.  Entries will be judged based on creativity, photographic quality and effectiveness in expressing the contest theme. Winners will be published on the “Caribbean Photo Contest” Web site. Limit one prize per winner. The results will render the three (3) finalist/s (i.e. Prize Winners).

*Prize winners will be notified by email and announced in our e-newsletter no later than 8 weeks after the end date of the contest.

Decisions of the Sponsors and Judges are final and binding. Sponsors reserve the right not to award all prizes in the event an insufficient number of eligible entries meeting the minimum judging criteria are received, as determined by Sponsors and Judges in their sole discretion.

If Sponsor determines, based on the application, that the entrant meets the Admissions Criteria, the entrant will be declared the Grand Prize winner. If Sponsor determines that the entrant does not meet the Admissions Criteria, then the entrant will be disqualified and Sponsor will select an alternate Grand Prize winner. Once the Grand Prize winner is confirmed, the Judges will select a Second and Third Place winner based on the Judging Criteria. Decisions of the Judges are final.

GENERAL LIABILITY RELEASE/FORCE MAJEURE:


Entrants (and any minor entrant’s parent or legal guardian) agree that Sponsor (A) shall not be responsible or liable for, and are hereby released from, any and all costs, injuries, losses or damages of any kind, including, without limitation, death and bodily injury, due in whole or in part, directly or indirectly, to participation in the Contest or any Contest-related activity, or from entrants’ acceptance, receipt, possession and/or use or misuse of any prize, and (B) have not made any warranty, representation or guarantee express or implied, in fact or in law, with respect to any prize, including, without limitation, to such prize’s quality or fitness for a particular purpose. Sponsor assumes no responsibility for any damage to an entrant’s, or any other person’s, computer system which is occasioned by accessing the Website or otherwise participating in the Contest, or for any computer system, phone line, hardware, software or program malfunctions, or other errors, failures, delayed computer transmissions or network connections that are human or technical in nature. Without limiting the generality of the foregoing, Sponsor is not responsible for incomplete, illegible, misdirected, misprinted, late, lost, damaged, stolen, or postage-due prize notifications; or for lost, interrupted, inaccessible or unavailable networks, servers, satellites, Internet service providers, websites, or other connections; or for miscommunications, failed, jumbled, scrambled, delayed, or misdirected computer, telephone or cable transmissions; or for any technical malfunctions, failures, difficulties or other errors of any kind or nature; or for the incorrect or inaccurate capture of information, or the failure to capture any information. Sponsor reserves the right in its sole discretion to disqualify any individual who is found to be tampering with the entry process or the operation of the Contest or the Website, to be acting in violation of these Official Rules, or to be acting in an unsportsmanlike or disruptive manner, or with the intent to disrupt or undermine the legitimate operation of the Contest, or to annoy, abuse, threaten or harass any other person, and Sponsor reserves the right to seek damages and other remedies from any such person to the fullest extent permitted by law. No mechanically reproduced, illegible, incomplete, forged, software-generated or other automated multiple entries will be accepted. Sponsor reserves the right to modify, extend, suspend, or terminate the Contest if it determines, in its sole discretion, that the Contest is technically impaired or corrupted or that fraud or technical problems, failures or malfunctions or other causes beyond Sponsor’s control have destroyed or severely undermined or to any degree impaired the integrity, administration, security, proper play and/or feasibility of the Contest as contemplated herein. In the event an insufficient number of eligible entries are received and/or Sponsor is prevented from awarding prizes or continuing with the Contest as contemplated herein by any event beyond its control, including but not limited to fire, flood, natural or man-made epidemic of health of other means, earthquake, explosion, labor dispute or strike, act of God or public enemy, satellite or equipment failure, riot or civil disturbance, terrorist threat or activity, war (declared or undeclared) or any federal state or local government law, order, or regulation, public health crisis, order of any court or jurisdiction, or other cause not reasonably within Sponsor’s control (each a “Force Majeure” event or occurrence), then subject to any governmental approval which may be required, Sponsor shall have the right to modify, suspend, extend or terminate the Contest. If the Contest is terminated for Force Majeure before the designated end date, Sponsor will (if possible) select the prize winners based on points accumulated as of the date of the event giving rise to the termination. Only the type and quantity of prizes described in these Official Rules will be awarded. These Official Rules cannot be modified or amended in any way except in a written document issued in accordance with law by a duly authorized representative of Sponsor. The invalidity or unenforceability of any provision of these rules shall not affect the validity or enforceability of any other provision. If any provision is determined to be invalid or otherwise unenforceable or illegal, these rules shall otherwise remain in effect and shall be construed in accordance with their terms as if the invalid or illegal provision were not contained herein.

GOVERNING LAW AND JURISDICTION
ALL ISSUES AND QUESTIONS CONCERNING THE CONSTRUCTION, VALIDITY, INTERPRETATION AND ENFORCEABILITY OF THESE OFFICIAL RULES OR THE RIGHTS AND OBLIGATIONS OF ENTRANTS OR SPONSOR IN CONNECTION WITH THE CONTEST SHALL BE GOVERNED BY AND CONSTRUED IN ACCORDANCE WITH THE INTERNAL LAWS OF THE STATE OF NEW JERSEY WITHOUT GIVING EFFECT TO ANY CHOICE OF LAW OF CONFLICT OF LAW RULES OR PROVISIONS THAT WOULD CAUSE THE APPLICATION OF ANY OTHER STATE’S LAWS.THIS CONTEST IS VOID WHERE PROHIBITED.

CONDITIONS

THIS CONTEST IS VOID WHERE PROHIBITED. Entrants agree that this Contest shall be subject to and governed by the laws of the State of New Jersey and the forum for any dispute shall be in the State of New Jersey, United States of America. To the extent permitted by law, the right to litigate, to seek injunctive relief or to make any other recourse to judicial or any other procedure in case of disputes or claims resulting from or in connection with this Contest are hereby excluded and any entrant expressly waives any and all such rights. Certain restrictions may apply. Entries void if the Sponsor determines the photograph to not be an original, or if the entries are illegible, incomplete, damaged, irregular, altered, counterfeit, produced in error or obtained through fraud or theft.

By entering, entrants also agree (a) to be bound by these Official Rules; (b) that the decisions of the Judges are final and binding with respect to all matters relating to the Contest; and (c) if the entrant wins, that Sponsor may use the winning photographs and each winner’s name, photograph, likeness, and/or voice in any publicity or advertising relating to the Contest or future promotions without compensation or approval (except where prohibited by law). All federal, state/provincial/territorial and local taxes, fees and surcharges and taxes (whether foreign or domestic, and including income, sales, and import taxes) on prizes are the sole responsibility of the prize winners. In the event that the selected winner(s) of any prize is/are ineligible, cannot be traced or do not respond within 10 days to a 9winner notification as required by the “Contest Prizes” Rules above, or refuses the prize, the prize will be forfeited and Sponsor, in its sole discretion, may choose whether to award the prize to another entrant.

RIGHT TO CANCEL OR SUSPEND CONTEST


If for any reason the Contest is not capable of running as planned, due to infection by computer virus, bugs, worms, Trojan horses, denial of service attacks, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of Sponsor that corrupt or affect the administration, security, fairness, integrity, or proper conduct of this Contest, Sponsor reserves the right, at its sole discretion, to disqualify any individual(s) who tamper with the entry process, and/or to cancel, terminate, modify, or suspend the Contest. If Sponsor elects to cancel or terminate the Contest, Sponsor will not retain any rights to the submitted photographs.

DATA PRIVACY

Entrants agree that personal data, especially name and address, may be processed, shared and otherwise used for the purposes and within the context of the Contest and any other purposes outlined in these Official Rules. The data may also be used by the Sponsor to verify the participant’s identity, postal address and telephone number or to otherwise verify the participant’s eligibility to participate in the Contest. Participants have the right to access, review, rectify or cancel any personal data held by Sponsor by writing to Sponsor at Caribbean Photo Contest LLC, P.O. Box 355 Perinneville, NJ 08535. Personal data will be used by Sponsor and its affiliates exclusively for the purposes stated herein.

NOTICE TO INDIVIDUALS: REMOVAL FROM MAILING LIST: Any individual (or other duly authorized person) may elect to exclude the name and address of that individual from all lists used by Caribbean Photo Contest, LLC to mail skill contests or Contest. To elect to have an individual’s name excluded from all such lists, submit a removal request in writing to: Caribbean Photo Contest, LLC. P.O. Box 355, Perinneville, NJ 08535.  This notification system may be used to prohibit mailing of all skill contests or Contest by Caribbean Photo Contest, LLC to such individual.

Professional

The “Professional” competition is judged on a body of work. Photographers must submit a minimum of 5 and maximum of 10 images and all submissions must be accompanied by a series description. 

WHO IS CONSIDERED PROFESSIONAL?
Photographers who earn, or have earned, the majority of their living from photography.

ELIGIBILITY The CPC PROFESSIONAL competition is open to any living photographer, 18 years of age or older, from any country. Professional photographers will be judged against other professionals. The Professional competition is judged on a body of work (3-10 images).

The Contest begins March 13 ends May 12, 2017 at 11:59 pm UTC (the Entry Deadline). An Extended deadline of May 27, 2017 will be issued after May 13, 2017 at 12:00 am UTC with a $10 per entry late fee. All entries must be received by the Extended Entry Deadline. By submitting an entry, each entrant agrees to the Official Rules and warrants that his or her entry complies with all requirements set out in the Official Rules. This is a skill-based contest and chance plays no part in the determination of winners.

Each Entry consists of an entry form, a single image or series of images, and an entry fee. The CPC “Professional” category entry fee is the $35.00 USD (single image) or $50.00 USD-Series (3 to 10 images).

To enter contest visit www.caribbeanphotocontest.com and complete the entry form online with all the required information, including your name and address, telephone number, e-mail address. Payments can be made by Credit Card, Money Order, or Check. Once entry fee is received entrants will receive permission to submit/upload images. Only images submitted/uploaded online will be accepted. No responsibility is assumed for lost, late or misdirected submission entries.

Each entry must comply with the requirements stated below:

  1. A) Submissions must be entered online at caribbeanphotocontest.comin accordance to the instructions specified in the general contest rules. Digital Files are the only acceptable format for submission. Only online entries will be eligible. No print or film submissions will be accepted for entry into this Contest. The photograph need not be taken with a digital camera; scans of negatives, transparencies or photographic prints are acceptable.

IMAGE SUBMISSION GUIDELINES  

  • All digital submissions must be no larger than 1600 Pixels in either height or width and saved as Jpegs (.jpg), in RGB format and not exceed 20MB per file, at 150dpi. Images will be viewed on a large monitor and should be in the Adobe RGB or sRGB color space. Filenames should contain contestants name and ranking number for the respective number of images entered. (Ex. File 001 – John Doe #1, File 002 – John Doe #2).
  • MANIPULATIONS/ MODIFICATIONS: Images that are modified are not allowed!! Minor burning, dodging and color correction is acceptable. (The original Raw or Tiff file of an image and/or negative should be saved for review in the event concerns arise regarding the authenticity of an image/s or unauthorized image modifications or manipulations.)
  1. B) AUTHENTICITY & COMPLIANCE: Images should be presented as taken, with as little alteration as possible. Please note: “No visible time or date stamps are allowed on entries”. Photographs must have been taken within (2) years before the date of entry and must not have been previously published.

The Caribbean Photo Contest LLC assumes no responsibility for images submitted to the contest by entrants that have been previously published. Winning images selected for final round are not allowed in future contests. Any winning image/photograph found to be altered will be disqualified from winning. Entrant must be the owner of the photograph, or otherwise have the right to submit the photograph for consideration in the Contest.

*Note

The entry submission page is expected to receive many visitors immediately before the entry deadline. If the website is experiencing a lot of traffic, issues may arise such as slow processing times or the inability to submit entries. To avoid these potential problems, you are encouraged to submit your entries about 14 days before the entry deadlines.

By entering the Contest, the entrant declares and assumes full responsibility for images and for ensuring that images are copyright protected. Entrant also acknowledges and warrants that the submitted image or photograph is the original work created solely by the entrant, that the photograph does not infringe upon any copyrights, trademarks, rights of privacy, publicity, or intellectual property of any person or entity and that no other party has any right, title, claim or interest in the photograph.

Any entrant whose photographic submission fails to comply with their requirements set forth may be disqualified. All submission entries that are not owned by the entrant and/or which are subject to the rights of third parties and/or if any persons appear in the photograph, the entrant’s responsible for obtaining any and all releases and consents necessary to permit and authorize the publication and use of the photograph in a manner set forth in the Official Rules without any additional compensation. If person appearing in any photograph is under the age of majority, the signature of a parent or legal guardian is required on release. If feasible, each entrant should be prepared to provide a signed written personal release from all persons who appear in the image/photograph submitted, and/or from the copyright owner of any sculpture, artwork or copyrighted material that appears in the photograph entry, authorizing use of the photograph entry, authorizing use of the photograph in editorial publications, marketing and promotions in any and all media.

  1. C) PAYMENT: The entry fee consists of two submission options 1) $35.00 USD – single image entrance fee or 2) $50.00 USD-Series (3 to 10 images) entrance fee. There is no limit on number of entries.

  1. D) ELIGIBILITY: This contest is open only to CPC Professional who are 18 years of age at the time of entry. Submission entries must be images created by the contestant/photographer. Any entries submitted that prove to be created by anyone other than the contestant will automatically be disqualified from the competition and will also be banned from participating in any other contest promoted by the Caribbean Photo Contest LLC – CONTEST IS VOID WHERE PROHIBITED.  

The CPC retains the right to refuse any entry for any reason.

IDENTIFYING MARKS AND SIGNATURES
No signature, stamp or any other identifying mark is allowed anywhere on the entry. If any identifying marks are submitted, entries will be automatically disqualified.

CATEGORY SUBMISSION GUIDELINES

The 2017 CPC “Professional” competition is “Open Themed”.  The competition asks photographers to submit the story behind the images they submit. Entries in this category must be a series. All text provided must be in English. Jurors will evaluate the weight of the text and the image equally.  

CONTEST PRIZES

Photographer of the Year

First Prize: One First Prize will be awarded. The First Prize consists of:

  1. A Seven (7) day / Six (6) night package for the winner and one (1) guest to Saint Lucia, West Indies;
  2. The winning image will be featured on the Caribbean Photo Contest website.
  3. Inclusion in Panel of Judges for upcoming contests.
  4. Qualify as a College Student Workshop Mentor.

One First Prize will be awarded. The First Prize consists of: (1) a 7-day / 6-night stay at Bay Gardens Beach Resort in Rodney Bay, Saint Lucia W.I. for the winner and one (1) guest in 2017; (2) the winning image will be featured on the Caribbean Photo contest website.

The First Prize will include Seven (7) days Six (6) nights’ accommodations at Bay Gardens Beach Resort (4 Star – award winning resort), ground transportation between the airport and hotel; and meals and other items including trip details are determined by Sponsor in its sole discretion. Travel must be completed by December 31, 2017 or prize trip will be forfeited. Airfare is NOT included. Travel expenses to/from the second prize winner’s home city are not included. Trip dates relate to travel from the United States. Accommodations are subject to availability. Trip specifics are subject to availability. Travelers agree to accept the Caribbean Photo Contest terms and conditions for the trip. All expenses and incidental travel costs not expressly stated in the package description above, including but not limited to, ground transportation; meals; incidentals; gratuities; passenger tariffs or duties; airline fees; surcharges; airport fees; service charges or facility charges; personal charges such as alcoholic beverages, spa services, and Internet usage; security fees; taxes or other expenses are the responsibility solely of winner. The winner and his/her travel companion must execute liability/publicity releases prior to issuance of travel documents. Winner and travel companion are solely responsible for obtaining valid passports and any other documents necessary for international travel. Sponsor reserves the right to substitute the trip for one of equal or greater value if the designated prize should become unavailable for any reason. Approximate Retail Value (“ARV”) of the First Prize is US $6,250. Actual value may vary based on airfare fluctuations and distance between departure and destination. Winner will not receive difference between actual and approximate retail value, if any.

Second Prize: One Second Prize will be awarded. The Second Prize consists of:

(1) A three (3) day / two (2) night package for the winner and one (1) guest to Saint Lucia, West Indies;

The Second Prize will include three (3) day / two (2) nights’ accommodations (accommodations are determined by Sponsor in its sole discretion). Travel expenses to/from the second prize winner’s home city are not included. Winner and guest are responsible for getting him/herself to and from Rodney Bay, Saint Lucia. Trip must be completed by December 31, 2017 or prize will be forfeited. Travelers agree to accept the Caribbean Photo Contest terms and conditions for the trip. All expenses and incidental travel costs not expressly stated in the package description above, including but not limited to, ground transportation; meals; incidentals; gratuities; passenger tariffs or duties; airline fees; surcharges; airport fees; service charges or facility charges; personal charges such as alcoholic beverages, spa services, and Internet usage; security fees; taxes or other expenses are the responsibility solely of winner. The winner and his/her travel companion must travel together on the same itinerary. Travel companion must execute liability/publicity releases prior to issuance of travel documents. Winner and travel companion are solely responsible for obtaining valid passports and any other documents necessary for international travel. Sponsor reserves the right to substitute the trip for one of equal or greater value if the designated prize should become unavailable for any reason. Third Prize: One Third Prize will be awarded. The Third Prize consists of:

  1. A $1000 B&H Pre-Paid Gift Card
  2. The winning image will be featured on the Caribbean Photo Contest website.

Actual value is $1000 USD. Winner will not receive difference between actual and approximate retail value, if any.

Potential winners shall be required to sign and return within ten (10) days following an attempted notification, an Affidavit, Declaration or Certificate of Eligibility, Liability Release, and where legally permissible, a Publicity Release and Warranty of Ownership and License in which the entrant warrants that he/she is the owner of the photograph (and all the intellectual property rights in the photograph submitted) and grants to Sponsor and its licensees the irrevocable, perpetual, worldwide non-exclusive license to reproduce, distribute, display, and create derivative works of the entry (along with a name credit) in connection with the Contest and promotion of the Contest without additional compensation. Failure to execute and deliver any required documents to Sponsor by the specified deadline may result in disqualification from the Contest, and selection of an alternate potential winner. No prize transfer, assignment, or substitution by winners permitted. If a prize (or part of a prize) is unavailable, the Sponsor, in its discretion, reserves the right to substitute the original prize (or that part of the prize) with an alternative prize to the equal monetary value and/or specification, unless to do so would be prohibited by law.

NONCOMPLIANCE OR RETURN OF PRIZE NOTIFICATION AS UNDELIVERABLE, WHETHER BY REGULAR MAIL OR BY E-MAIL, MAY RESULT IN DISQUALIFICATION AND SELECTION OF AN ALTERNATIVE POTENTIAL WINNER.

JUDGING

The criteria for judging entries is a combination of technical competencies, visual communication/conveyance, journalistic standards (If submission is Photojournalistic), and the photographer’s creativity and visual skills. The story in concert with the images, the edit of the material submitted is also taken into account.

USE AND OWNERSHIP OF IMAGES
Copyright and all other rights remain that of the photographer. Any photograph used by CPC PROFESSIONAL shall carry the photographer’s credit line. Use may include publication in any CPC PROFESSIONAL media sponsor publication/s. All entrants understand that any image submitted to the competition may be used by CPC PROFESSIONAL for marketing and promotional purposes including in any media such as exhibitions, print and digital media directly related to the CPC PROFESSIONAL  competition, though there may not be monetary compensation. By winning or placing in the competition you are agreeing to be included in the winners’ annual.

Neither Caribbean Photo Contest., nor their associates, affiliates, or partners assumes any responsibility for photos submitted in violation of competition rules, or for those which violate copyright regulations. CPC will investigate claims of copyright infringement to the best of its ability, and will remove and disqualify images that are clearly demonstrated to violate copyright and/or competition policies. CPC will act to maintain the integrity of the competition and its affiliated entities, but is not responsible for any damages resulting from images submitted in violation with rules and regulations.

WINNERS

Entrants are responsible for complying with these Official Rules. Prize winners’ names will be available online June 19, 2017 at www.caribbeanphotocontest.com.

ENTRANT LICENSES/RELEASES

If the photograph contains any material or elements that are not owned by the entrant and/or which are subject to the rights of third parties, and/or if any persons appear in the photograph, the entrant is responsible for obtaining, prior to submission of the photograph, any and all releases and consents necessary to permit the exhibition and use of the photograph in the manner set forth in these Official Rules without additional compensation. If any person appearing in any photograph is under the age of majority in their state/province/territory of residence the signature of a parent or legal guardian is required on each release.

Upon Sponsor’s request, each entrant must be prepared to provide (within 7 calendar days of receipt of Sponsor’s request) a signed release from all persons who appear in the photograph submitted, and/or from the owner of any material that appears in the photograph entry, authorizing Sponsor and its licensees (“Authorized Parties”) to reproduce, distribute, display and create derivative works of the entry in connection with the Contest and promotion of the Contest, in any media now or hereafter known. All releases must be in the form provided by Sponsor. Failure to provide such releases upon request may result in disqualification at any time during the Contest and selection of an alternate winner.

Similarly, upon Sponsor’s request, each entrant must be prepared to provide (within 7 calendar days of receipt of Sponsor’s request) a signed written license from the copyright owner of any sculpture, artwork or other copyrighted material that appears in the photograph entry, authorizing any Authorized Party to reproduce, distribute, display and create derivative works of the entry in connection with the Contest and promotion of the Contest, in any media now or hereafter known. All releases must be in the form provided by Sponsor. Failure to provide such releases upon request may result in disqualification and selection of an alternate winner.

Finally, upon Sponsor’s request, each entrant must be prepared to provide (within 7 calendar days of receipt of Sponsor’s request) a signed written license from the owner of any private property included in the photograph entry, authorizing any Authorized Party to reproduce, distribute, display and create derivative works of the entry in connection with the Contest and promotion of the Contest, in any media now or hereafter known. All releases must be in the form provided by Sponsor. Failure to provide such releases upon request may result in disqualification and selection of an alternate winner.

For the purposes of these Official Rules, the entrant will be deemed to be in receipt of Sponsor’s request or notification, (a) in the event that Sponsor sends the request by postal mail, five business days after the request was sent by Sponsor, or (b) in the event that Sponsor sends the request by e-mail, on the day that the e-mail was sent by Sponsor.

By participating, ALL ENTRANTS grant the Sponsors and their designees, licensees or affiliates (the “Authorized Parties”) a non-exclusive, worldwide license, through December 24, 2021, to reproduce, distribute, display and post the entries online so that viewers may view all competing entries. In addition, each WINNER grants to the Authorized Parties a license for use of his/her winning entry in connection with the Contest and promotion of the Contest, in any media now or hereafter known, including but not limited to, print or digital publication on the CPC Website showcasing the winners; and promotions related to the contest. Authorized Parties will not be required to pay any additional consideration or seek any additional approval in connection with such use.

THIRD PARTY RELEASES/LICENSES

Winners authorize The Caribbean Photo Contest to reproduce, distribute, display and create derivative works of the photograph entry in connection with 2017/2018 Photo Contest and promotion of 2017/2018 Photo Contest, in any media now or hereafter known, including but not limited to: publication on The CPC website showcasing the winners; The 2017/2018 Photo Contest live gallery; the 2017/2018 Photo Contest Web site and in exhibits and promotions related to the 2017/2018 photo contest.

LIMITATION OF LIABILITY

By participating, entrants agree to release, discharge and hold harmless Caribbean Photo Contest, and each of their respective partners, affiliates, subsidiaries, advertising agencies, agents and their employees, officers, directors, and representatives from any claims, losses, and damages arising out of their participation in this Contest or any Contest-related activities and the acceptance and use, misuse, or possession of any prize awarded hereunder.  

Sponsors assume no responsibility for any error, omission, interruption, deletion, defect, or delay in operation or transmission; communications line failure; theft or destruction of or unauthorized access to Contest entries or entry forms; or alteration of entries or entry forms. Sponsors are not responsible for any problems with or technical malfunction of any telephone network or lines, computer online systems, servers or providers, computer equipment, software, failure of any email entry to be received on account of technical problems or traffic congestion on the Internet or at any Web site, human errors of any kind, or any combination thereof, including any injury or damage to entrants’ or any other persons’ computers related to or resulting from participation, uploading or downloading of any materials related to this Contest.

CONDITIONS

THIS CONTEST IS VOID WHERE PROHIBITED. Entrants agree that this Contest shall be subject to and governed by the laws of the State of New Jersey and the forum for any dispute shall be in the State of New Jersey, United States of America. To the extent permitted by law, the right to litigate, to seek injunctive relief or to make any other recourse to judicial or any other procedure in case of disputes or claims resulting from or in connection with this Contest are hereby excluded and any entrant expressly waives any and all such rights. Certain restrictions may apply. Entries void if the Sponsor determines the photograph to not be an original, or if the entries are illegible, incomplete, damaged, irregular, altered, counterfeit, produced in error or obtained through fraud or theft.

By entering, entrants also agree (a) to be bound by these Official Rules; (b) that the decisions of the Judges are final and binding with respect to all matters relating to the Contest; and (c) if the entrant wins, that Sponsor may use the winning photographs and each winner’s name, photograph, likeness, and/or voice in any publicity or advertising relating to the Contest or future promotions without compensation or approval (except where prohibited by law). All federal, state/provincial/territorial and local taxes, fees and surcharges and taxes (whether foreign or domestic, and including income, sales, and import taxes) on prizes are the sole responsibility of the prize winners. In the event that the selected winner(s) of any prize is/are ineligible, cannot be traced or do not respond within 10 days to a winner notification as required by the “Contest Prizes” Rules above, or refuses the prize, the prize will be forfeited and Sponsor, in its sole discretion, may choose whether to award the prize to another entrant.

The Sponsor reserves the right to verify the validity and originality of any entry and/or entrant (including an entrant’s identity and address) and to disqualify any entrant who submits an entry that is not in accordance with these Official Rules or who tampers with the entry process. Failure by the Sponsor to enforce any of its rights at any stage does not constitute a waiver of those rights.

RIGHT TO CANCEL OR SUSPEND CONTEST

If for any reason the Contest is not capable of running as planned, due to infection by computer virus, bugs, worms, trojan horses, denial of service attacks, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of Sponsors that corrupt or affect the administration, security, fairness, integrity, or proper conduct of this Contest, Sponsors reserve the right, at their sole discretion, to disqualify any individual(s) who tamper with the entry process, and/or to cancel, terminate, modify, or suspend the Contest. If Sponsors elect to cancel or terminate the Contest, Sponsors will not retain any rights in the submitted photographs and will return the entry fees.

DATA PRIVACY

Entrants agree that personal data, especially name and address, may be processed, shared and otherwise used for the purposes and within the context of the Contest and any other purposes outlined in these Official Rules. The data may also be used by the Sponsor in order to verify the participant’s identity, postal address and telephone number or to otherwise verify the participant’s eligibility to participate in the Contest. Participants have the right to access, review, rectify or cancel any personal data held by Sponsor by writing to Sponsor at Caribbean Photo Contest, P.O. Box 355 Perinneville, NJ 08535.  Personal data will be used by Sponsor and its affiliates exclusively for the purposes stated herein.

NOTICE TO INDIVIDUALS: REMOVAL FROM MAILING LIST: Any individual (or other duly authorized person) may elect to exclude the name and address of that individual from all lists used by Caribbean Photo Contest to mail skill contests or sweepstakes. To elect to have an individual’s name excluded from all such lists, submit a removal request in writing to: Caribbean Photo Contest, P.O. Box 355, Perinneville, NJ 08535.  This notification system may be used to prohibit mailing of all skill contests or sweepstakes by the Caribbean Photo Contest to such individual.
